1. These terms. These terms and conditions form the complete agreement under which you, as a seller, will do business with us (Cantalis Ltd, trading as StuffUSell). We may at any time update these terms and conditions by publishing new terms and conditions on our website at http://www.stuffusell.co.uk/terms.htm which shall constitute notice to you of any such change. Any new terms and conditions so published will supercede these from their time of publication. These terms and conditions are governed by the laws of England and Wales. Any dispute shall be subject to the jurisdiction of English Courts

2. Our services to you. We will collect (where agreed) and hold your items for sale and offer them for auction on eBay. We will prepare the auction listing and answer questions from bidders. At the end of the auction, we will collect payment from the buyer and pay any fees. We will arrange delivery to the buyer and deal with any returns. Once payment is cleared and the returns period is over, we will send payment to you less our fees. We may wait for other items in your batch to clear before processing payment.

3. Our auctions. Our auctions will be run according to the rules currently in force on eBay. It will be entirely at our discretion how to list the items in the auction, including, but not limited to, collecting items together to form larger lots or splitting out groups of items. We will set reserves or minimum bids where we choose, except when a specific reserve or starting price has been agreed on the lot registration form and paid for. The final price will be determined by the highest bid which we reasonably accept, and is not under our control. You understand that prices for identical lots may vary according to bidder demand. Upon receipt of payment from the buyer, you will pass title of ownership directly to them. We will not take ownership of any item as part of this process. The eBay rules currently allow the buyer a 7 day return window during which they may reverse this transaction. If the buyer does reverse this, we may offer the lot to other bidders, possibly at a lower price, or relist the item for re-auction.

4. Our fees. Our fees will be as most recently published on our website at http://www.stuffusell.co.uk/fees.htm when you sign the lot registration form, unless otherwise agreed in writing. These are currently a £5 listing fee per item plus thirty-five percent commission on the final sale price. Collection charges will usually be quoted separately for your job, and start from £25 for a small London collection. Reserve prices which you mandate cost £10, refunded if the item sells with the reserve. Premium listings cost £50 for each auction and include a reserve price. VAT is additionally chargeable at current rates

5. Your obligations. When consigning any of your items for sale, you warrant that they are your own and that you are not constrained from selling them in any way. You will include in the item description all material information, including any defects known to you and warrant that this description is not misleading in any way. You will not offer for sale any items prohibited by eBay in their rules. You will not do or say anything which will interfere with the proper and fair progress of the auction once underway. You indemnify us for any loss or damage due to inaccuracies in your description, or any actions you take which affect the auction.

6. Your personal information. We will hold your personal information electronically. We will use this information to deal with you in setting up your account and in the normal course of doing business with you. We may from time to time wish to contact you with information and offers. We will ask you to opt-in to this when you sign up, and you may opt-out of this at any time. We will never sell your information to a third party, and will only disclose it where we are obliged to in order to resolve a dispute or are compelled to by law.

7. Our liability. We are not liable for any loss or damage - direct, consequential or loss of profit - that you may suffer as a result of this agreement. In particular we make no representation about the selling price of your items. In all cases - except where provided otherwise by statute - our absolute liability shall be limited to the selling price of your items, or agreed start price if unsold.
